40 When Lights Flash Sign

Buses use orange flashing wigwag lights — along with this sign — to warn drivers that they are picking up or setting down school children. When you see the lights flashing, you must not pass the bus at more than 40 km/h.

When Do the Lights Flash?

Lights begin flashing when the bus stops and the doors are opened.

They continue flashing for approximately 30 seconds after the doors close — and keep flashing even after the bus starts moving again, as children may still be crossing.

The 40 km/h limit applies for the full duration the lights are flashing — not just while the bus is stationary.


Which Drivers Does This Apply To?

The rule applies to vehicles travelling in the same direction as the bus. Drivers travelling in the opposite direction on the other side of the road are not required to slow to 40 km/h.

If a lower speed limit already applies in the area (such as a 40 km/h school zone), that limit takes precedence — but the flashing lights rule still applies regardless of the posted limit.

Penalties for Non-Compliance

NSW Road Rules — Fines & Demerit Points

Passing at more than 40 km/h while lights are flashing — $149 fine + 1 demerit point (for 10 km/h or less over).

Learner and P-plate drivers face 4 demerit points for the same offence — which can result in licence suspension.

Higher fines apply for exceeding the limit by greater amounts. Double demerits may apply during holiday periods.


Flashing Headlights

When dropping off or picking up school children, the driver may also flash the bus headlights at approaching drivers. This is an additional warning that children are crossing or about to cross the road — the children may not yet be visible from where other drivers are positioned.
